In this article, we consider the issues surrounding confidentiality in arbitration proceedings. With reference to recent case law, in particular, Wilson v Emmott (2008), we set out the four circumstances where disclosure in court proceedings of documents generated in English arbitrations involving the same parties would be permissible.
