The Environmental Liability Directive is designed to harmonise
environmental liability law across the EU. In this article, we look
at the second public consultation on the implementation measures
for England and Wales, which include draft implementing regulations
and draft guidance and paves the way for implementation before the
end of 2008. The article also summarises the regime set out in the
draft regulations and highlights the additional liability risk that
the regime presents for operators and insurers if it becomes law as
proposed.
